Terms & Conditions

CANCELLATIONS AND RESCHEDULING

  • You may cancel your booking up to 48 hours before the start time to receive a full refund.

  • Cancellations made less than 48 hours before the start time are non-refundable.

  • You may reschedule your class up to 72 hours before the start time, subject to availability.

  • If we (organisers or instructors) cancel a class for any reason, you will receive a full refund or the option to reschedule. This includes weather-related cancellations before the class begins.

  • If a class is already in progress and must be stopped due to deteriorating weather, refunds will not be issued.

GROUP CLASS VIABILITY

Group classes require a minimum number of participants. If fewer than three people have booked, we reserve the right to reschedule or rearrange the lesson at a mutually agreed time.​

SAFETY EQUIPMENT

  • All participants are strongly advised to wear full safety equipment (helmet, wrist guards, elbow pads, and knee pads) during lessons.

  • For group classes, safety equipment and boards may be rented at booking for a small additional fee.

  • For private classes, the use of helmet, pads, and boards is included in the class price (i.e. no separate rental charge).

  • If you already own suitable equipment, you are welcome to bring it.

LATE ARRIVALS AND SESSION START

  • Please arrive on time so that the session can start and finish on schedule.

  • If you arrive late, we will do our best to include you for the remainder of the class time, but cannot guarantee to extend the class or offer any refund for the missed portion.

  • In group classes, late arrivals may disrupt the session; the instructor may decide whether to allow you to join late or catch up privately.

ASSUMPTION OF RISK, DUTY OF CARE & ACCIDENT LIABILITY

  • Skateboarding, rollerblading, and similar activities are adventure / extreme sports involving inherent risks, including risk of injury, damage, or loss.

  • By booking and signing our waiver, you acknowledge these risks, and accept that you are participating at your own risk.

  • Soulful Skate Co. and its instructors will always strive to care for your safety, provide instruction in line with best practices, and assist in the event of injury.

  • Nevertheless, we do not accept liability for injuries, accidents, or damages incurred during sessions or when practising the techniques outside formal class time.

  • You must disclose any medical conditions, physical limitations, or injuries in the waiver.

PHOTOGRAPHY & MEDIA

  • We may take photographs or video during lessons for promotional, marketing or social media use.

  • If you prefer not to be included, please indicate this in your waiver.

  • Participants (or parents/guardians) may not photograph or film other participants without their consent.

 

DATA PROTECTION, PRIVACY & EMAIL MARKETING

a) Data Collection, Use & Retention

  • We collect personal data (including name, contact information, emergency contact details, health disclosures, and waiver responses) to provide safe and effective services.

  • This data is stored securely and used only for:

    1. organising and operating classes,

    2. ensuring participant safety and informing emergency services in case of an accident,

    3. essential communications (e.g., class updates, cancellations).

  • We do not share personal data with third parties except where necessary (e.g. payment processors, email service providers) under appropriate data processing agreements.

  • We retain your personal data only for as long as reasonably necessary, or as required by legal, insurance or safety obligations.

  • When data is no longer needed, it will be securely deleted or anonymised in line with our data retention schedule.

b) Email Newsletters & Marketing

  • If you opt into receiving our email newsletter or promotional communications, we will process your personal data in accordance with UK GDPR and the Privacy and Electronic Communications Regulations (PECR).

  • In most cases, explicit consent is required to send marketing emails to individuals (especially B2C).

  • In limited circumstances, we may rely on a “soft opt-in” / legitimate interest basis for sending marketing emails to existing customers, provided that:

    1. Your contact details were collected during a sale or negotiation of a sale,

    2. You were given a clear opportunity to opt out when your details were collected, and

    3. Every subsequent message includes an easy opt-out method.

  • Recipients always have the right to object to receiving marketing emails, and if you do so, we will cease sending them.

  • We periodically clean our mailing list, remove unsubscribed addresses, and may delete inactive subscribers in accordance with our retention policy.

 

WAIVER AND LIABILITY 

  • Participation in our lessons requires signing our waiver, which you can view here: Waiver

  • By signing, you confirm that you understand the risks, have disclosed any relevant medical conditions, and accept responsibility for injury or damage.

  • This waiver forms part of these Terms & Conditions.

SAFEGUARDING AND CHILD PROTECTION

  • Our safeguarding and child protection policy applies to all participants under 18 and vulnerable persons. You can view it here: Safeguarding & Child Protection.

  • If you are responsible for a minor, you must ensure that they behave appropriately, follow instructions, and wear the required safety equipment.

OTHER PROVISIONS AND MISCELLANEOUS 

  • Behaviour & Conduct: We reserve the right to refuse service or remove participants who behave recklessly, abusively, or in violation of these Terms.

  • Force Majeure: We shall not be liable for failure to provide service caused by circumstances beyond our control (e.g. extreme weather, closure of venue, strikes).

  • Severability: If part of these Terms is held invalid, unlawful or unenforceable, the remaining provisions continue in full effect.

  • Amendments: We may update these Terms & Conditions from time to time. The version in force is the one published on our website at the time of your booking.

ACCEPTANCE

By booking a class or using our services, you accept these Terms & Conditions in full.
